届本科毕业论文 论文（设计）题目 未成年人犯罪的刑罚问题研究 学生姓名：__ ______ 所在系别：________ 所学专业：_ _______ 导师姓名：_ _______ 完成时间： ____ PAGE II PAGE II 未成年人犯罪的刑罚问题研究 摘要 随着未成年人犯罪呈现低龄化，进一步完善未成年人犯罪刑罚制度成为各国争相关注、研究的重大课题。未成年人的犯罪刑罚制度的优劣，是未成年人犯罪预防、降低犯罪率、教育、矫正等问题的解决的关键。我国的未成年人刑罚体系为重刑机构，多监禁刑，规定简单粗陋，有许多问题需要学界去关注和研究。应立足我国实际，以“教育为主、惩罚为辅”为基本原则，构建出刑罚轻缓化、刑罚非监禁化、矫正社会化的未成年人犯罪刑罚制度。本文首先从未成年人犯罪刑罚制度的定义展开论述，理清未成年人犯罪刑罚制度的一些基本概念，之后采用分析的方法，对我国未成年人犯罪刑罚制度现状进行评析。针对我国未成年人犯罪刑罚所存在的问题，本文在根据我国国情的基础上提出了一些具体的完善建议，包括：废除财产刑，完善剥夺政治权利刑，完善减刑、假释制度等，并参考和借鉴国外先进做法，提出了引入社区服务刑的构想，期望对完善我国的未成年人犯罪刑罚制度有所作用。 关键词: 未成年人犯罪,刑罚,完善 Minor Crime Punishment Problem Research Abstract With the trends of lower age for juvenile delinquency, the further improvement in penal system for juvenile delinquency was an important issue which was researched and concerned all over the world. The advantages and disadvantages of penal system for juvenile delinquency were the key to solve problems such as preventing juvenile delinquency, reducing crime, education, and so on. In our country, the penal system for juvenile delinquency was a severe punishment organization, and the regulations were simple and rough, so there were many blind spots need to be researched and concerned by academics. According to the reality of our country and the basic principles like “focus on education, supplemented by punishment”, we could build the penal system for juvenile delinquency with penalty modest, penalty non-imprisonment, and correction socialization. In this dissertation, discussed the definition of penal system for juvenile delinquency and clarified some basic concepts of it, and then analyzed the present situation of penal system for juvenile delinquency. As for the problems of penal system for juvenile delinquency, some suggestions were proposed according to conditions of our country including the abolition of property penalty, improvement of deprivation of political torture, improvement of the systems of commutation and rel
